Legal Requirements for Your Will

Washington probate courts show deference to the terms and provisions of a valid will when they administer your estate. If a will is found to be invalid, the person will be found to have passed “intestate” and the estate will be administered in accordance with Washington’s laws of intestate succession. Under these laws, the decedent is presumed to have intended to give their property and assets to relatives and heirs, regardless if that was your actual intent. When there are no living relatives or other close family members, the property in the estate will belong to the government.

In the state of Washington, wills are valid when the following is satisfied:

  • The testator is over 18 years old and they created and signed the will when they were of sound mind and judgement
  • The will was written and signed (executed) by the actual testator
  • The will was executed in front of two witnesses or in the presence of a notary public
  • The testator understands that the provisions in the will they sign will be carried out during the probate process after they pass
