What Happens During Probate?

A decedent’s estate will go through probate to determine the beneficiaries’ rights to some or all of an individual’s estate. This is based on the decedent’s wishes, as devised in their last will and testament, if one exists.

The probate process will resolve issues related to:

  • Real estate and land titles
  • Assets held in bank accounts, investment accounts, bonds, and retirement plans
  • Life insurance benefits
  • Distributing personal property
  • Dividing or passing on business interests
  • Paying off debts of the estate
  • Resolving disputes among beneficiaries

Small Estate Administration in Washington

State law provides for an expedited probate process for estates valued at less than $100,000. In this case, a small estate affidavit may be issued 40 days after the death of your loved one. This affidavit states your claim as the successor of the estate and the total value of the estate, among other things, in order to begin the transfer of any property to the living heir or beneficiary. All debts of the estate must also be paid.
