What Does Probate Mean?

Probate is the legal process that occurs when a person dies and his / her estate is distributed.

The estate is distributed in one of two ways:

  • If there is a will, the estate will be distributed according to the terms of the will
  • If there is not a will, the estate will be distributed according to intestate succession laws

What Is an "Estate?"

In terms of probate, the "estate" includes everything owned by the individual in question. This includes real property, cash, personal property, and so forth.

For example, the estate may include:

  • Real estate
  • Bank accounts
  • Stocks and bonds
  • Vehicles
  • Businesses
  • Proceeds from insurance policies
  • Financial investments
  • Retirement plans
  • Business interests
  • Furniture, art, jewelry and other personal belongings / heirlooms

Do I Need to File a Probate?

In some cases, probate may not be required. When an individual passes away with a very small estate, the court may not need to get involved in asset distribution to beneficiaries. If the individual passed away with all his / her belongings in co-ownership with a spouse, child or other individual, those assets will go directly to the co-owner and probate will not be necessary.

Probate is required to deal with matters such as:

  • Clearing land titles
  • Clearing large bank / savings accounts
  • Clearing stocks and bonds
  • Collecting debts that were owned to the individual who has deceased
  • Clearing up disagreements / disputes between beneficiaries
