Taking Your Child on a Trip After Divorce

Following Your Custody Agreement

Traveling with children after a divorce can be complicated, especially if you are a non-custodial parent. Not only do you need to make sure that your travel plans meet the requirements of your child custody agreement, but you also need to ensure that both parents agree to the trip.

Planning ahead and understanding what rules apply when taking a child on a trip after going through a divorce is essential. This blog will provide helpful tips for ensuring an enjoyable and stress-free journey while respecting the rights of all parties involved.

Permission From the Other Parent

One of the most critical steps in traveling with children after a divorce is obtaining the other parent's permission. Depending on state laws, this may require written authorization or even a court order. If you are planning to take your child out of the country, it is absolutely essential that you have the other parent's written consent before doing so – even if you are the custodial parent.

Additionally, remember that having one parent's consent isn't enough to travel with a child after divorce. Both parents must agree on the type of trip and any arrangements related to the journey. It's vital to clearly understand all expectations before embarking on your trip.

Giving the Other Parent the Details

Once the other parent has consented, be sure to provide them with all the details and arrangements related to the trip. This should include the dates and duration of your stay, where you will be staying, your travel contact information, and any other relevant details. Providing them with a copy of any documents related to the trip (e.g., airline tickets, hotel reservations, etc.) is also a good idea.

These additional steps will help ensure that both parents are on the same page and that everyone involved is comfortable with the plans.

Work With a Family Law Attorney When Issues Arise

Traveling with children after a divorce can be complicated but doesn't have to be a stressful or difficult process. If any issues arise, it's essential to consult with a family law attorney who can help you navigate the complex legal system and provide guidance on how best to proceed. By following these tips, you can ensure that your trip is stress-free and enjoyable for all involved.

The team at Pacific Cascade Legal can help resolve any child custody issues that arise post-divorce. Learn more about how we can help or schedule a consultation by calling (888) 981-9511 or visiting our website.
