Oregon Child Custody Laws

There are two types of child custody: physical custody and legal custody. Physical custody refers to where the children will live, while legal custody means who has the authority to make decisions about on behalf of the child, such as where they go to school, where they receive their medical treatment, and what religion they follow.

The court determines whether parents have either joint custody or sole custody. The main preference among judges is to order joint custody for children to have a continuous relationship with both parents, whether the parents receive split parenting time, or one parent receives primary custody while the other gains visitation time.

One the other hand, if one parent has the children for most of the time or the other parent is unfit to take care of the child, then the court will award sole custody. The noncustodial parent will still obtain visitation rights.

The court will decide on child custody matters based on the child’s best interests, which consists of the following factors:
